Terms of Service

1. About the service

Digital Skademelding is a digital service for completing the European Accident Statement. Two parties in a traffic accident fill in their respective sides of the form on their phones, sign digitally, and receive the completed report as a PDF by email.

2. Seller

The service is provided by HEM, a sole proprietorship registered in Norway with organisation number 924 807 342 and business address Folke Bernadottes vei 6, 0862 Oslo. Digital Skademelding (skademeldingbil.no) is the trading name used for the service.

3. Acceptance of these terms

By using the service, you confirm that you have read, understood, and accepted these terms.

4. Price and payment

The service costs 399 NOK per accident report, including 25% Norwegian VAT (MVA). You pay by card via Stripe.

Payment is a one-time charge and is processed when you confirm the purchase.

5. Delivery

The accident report is generated on our server as soon as both parties have signed, or once Party A has signed and paid alone. The PDF is delivered as an email attachment to both parties.

You can also access the report on your account page (β€œmin side”) when logged in.

6. Your responsibilities

You are responsible for ensuring that the information you provide is accurate. Digital Skademelding is a tool for completing and signing the form digitally, and does not provide legal advice.

We are not a party to the insurance settlement between you and the other driver, and are not responsible for the content of the completed report.

7. Right of withdrawal

As a consumer, you have a 14-day right of withdrawal under Norwegian law. Because the report is delivered digitally and immediately, by completing checkout you consent to delivery beginning right away, and you acknowledge that the right of withdrawal is lost once the service has been fully performed.

In practice, the right of withdrawal lapses at the moment we generate the report and send it as a PDF by email. Until that point, you can withdraw by sending us a message at our contact address.

8. Complaints

A complaint about service errors is different from a right of withdrawal β€” it concerns defects in our service itself, not a change of mind on your part.

If you experience an error on our side (for example a corrupt or incomplete PDF, a missing signature, or a technical issue with the service), please contact us at [email protected] within a reasonable time. We will correct the issue free of charge, or refund the purchase if the issue cannot be corrected.

Disagreements between you and the other driver, or between you and your insurance company, are not considered complaints about our service.

9. Privacy

We process personal data in accordance with our privacy policy.

10. Changes to these terms

We may update these terms from time to time. The current version is published on this page, and continued use of the service after an update is considered acceptance of the new terms. Changes do not apply to purchases that have already been completed.

11. Disputes and venue

If something goes wrong, we want to resolve it directly. Please reach out at [email protected] and we will look into it.

If we cannot reach an agreement, you may bring the matter before Forbrukertilsynet (the Norwegian Consumer Authority) or Forbrukerklageutvalget (the Norwegian Consumer Complaints Board). Norwegian law applies, with Oslo District Court as the legal venue. Consumers nevertheless retain the right to bring proceedings in their own home court pursuant to the Norwegian Disputes Act (tvisteloven).
